Terms of Use
1. Acceptance of Terms
By accessing or using BDALab, you agree to these Terms of Use and any policies referenced here. If you do not agree, do not use the service. These terms apply to visitors, account holders, purchasers, and anyone who submits practice responses or books tutoring.
2. Educational Practice Only
BDALab is an independent educational preparation tool. It provides practice scenarios, Decision Arcade questions, AI-generated feedback, saved history, optional human review, and tutoring. BDALab does not provide official CASPer scoring, admissions advice, medical, legal, financial, or professional advice, and does not guarantee admission, interview invitations, test results, a CASPer quartile, or any academic or career outcome.
3. No Affiliation
BDALab is not affiliated with, endorsed by, sponsored by, or approved by CASPer, Acuity Insights, Altus Assessments, any admissions office, university, medical school, professional school, test administrator, or application service. All trademarks belong to their respective owners.
4. Accounts and Security
You are responsible for the accuracy of the information you provide, for maintaining the confidentiality of your login credentials, and for all activity under your account. You agree not to share paid access, resell accounts, impersonate others, bypass access controls, or use automated scraping, abuse, or attack methods. We may suspend or terminate access if we reasonably believe these terms are violated.
5. AI Feedback Limitations
AI feedback is generated automatically and may be incomplete, inaccurate, inconsistent, delayed, unavailable, or unsuitable for your situation. It is provided for practice only. You are responsible for evaluating feedback critically and making your own study, application, and professional decisions.
6. Human Review and Timing
Human review is an educational coaching service, not official scoring. Any stated turnaround, including references to review in under 5 hours, is a good-faith target and service expectation, not an absolute promise. Turnaround may be affected by payment verification, incomplete submissions, technical issues, reviewer availability, outages, emergencies, high demand, holidays, force majeure, or events outside BDALab's control. BDALab, its founder, reviewers, and contractors are not liable for any delay, missed deadline, lost opportunity, stress, application impact, or other consequence arising from review timing.
7. Tutoring
Tutoring sessions are educational coaching sessions. Booking a session does not guarantee a score, admission outcome, interview offer, or particular improvement. You are responsible for choosing a suitable time, attending on time, providing accurate contact information, and ensuring your internet, calendar, and device setup work. Tutoring bookings are non-refundable unless required by law or BDALab chooses otherwise in its sole discretion.
8. Memberships, Credits, and Access
Memberships provide access for the selected period and may be limited by reasonable technical, anti-abuse, maintenance, or operational controls. Human review credits are account-based, have no cash value, and are not transferable unless BDALab agrees in writing. We may modify, pause, replace, or discontinue features, content, scenarios, arcade questions, guide materials, or pricing at any time.
9. Payments, Prices, and Taxes
Payments are processed by third-party providers such as Stripe. Prices are displayed before checkout and may include promotions or sale comparisons that can change at any time. You authorize the selected charge and are responsible for applicable taxes, payment information accuracy, bank fees, currency conversion fees, and any charges from your payment provider.
10. Refunds and Chargebacks
Except where required by law, purchases are final and non-refundable once access is provided, credits are delivered, a review is submitted, or a tutoring booking is created. If you believe there was a billing error, contact us first so we can review it in good faith. Abusive chargebacks, fraudulent disputes, or payment reversals may result in account suspension and loss of access.
11. User Content
You retain responsibility for responses, prompts, notes, and other content you submit. You grant BDALab permission to process, store, display, analyze, transmit, and share your submitted content as needed to provide AI feedback, human review, tutoring, account history, support, security, analytics, and service improvement. Do not submit unlawful, confidential third-party, identifying patient, or sensitive information that you do not have the right to share.
12. Acceptable Use
You may not misuse BDALab, reverse engineer or copy substantial portions of the platform, scrape content, overload systems, attempt unauthorized access, interfere with security, submit harmful code, harass reviewers or users, use the service for illegal purposes, or use outputs to misrepresent your abilities, credentials, or authorship.
13. Intellectual Property
BDALab, including its design, software, scenarios, arcade questions, explanations, feedback formats, branding, and content, is owned by BDALab or its licensors and is protected by intellectual property laws. You receive a limited, revocable, non-transferable license to use the service for personal preparation only.
14. Third-Party Services
BDALab may rely on third-party providers for payments, hosting, email, analytics, AI processing, and other functions. We are not responsible for third-party services, outages, acts, omissions, data handling, fees, or terms. Your use of third-party checkout or authentication may also be governed by those providers' terms.
15. Disclaimers
BDALab is provided on an as-is and as-available basis. To the fullest extent permitted by law, BDALab disclaims all warranties, express or implied, including warranties of accuracy, reliability, merchantability, fitness for a particular purpose, availability, non-infringement, and uninterrupted or error-free operation.
16. Limitation of Liability
To the fullest extent permitted by law, BDALab, its founder, owners, reviewers, tutors, contractors, service providers, and affiliates are not liable for indirect, incidental, consequential, special, punitive, exemplary, or lost-profit damages, or for admissions outcomes, exam outcomes, delayed reviews, lost data, lost opportunities, emotional distress, or reliance on feedback. Where liability cannot be excluded, total liability is limited to the amount you paid to BDALab for the specific service giving rise to the claim in the three months before the event.
17. Indemnity
You agree to defend, indemnify, and hold harmless BDALab, its founder, owners, reviewers, tutors, contractors, and service providers from claims, losses, liabilities, damages, costs, and expenses arising from your use of the service, your submitted content, your violation of these terms, your payment disputes, or your violation of another person's rights.
18. Changes, Suspension, and Termination
We may update these terms, change the service, suspend features, restrict access, or terminate accounts at any time when reasonably necessary for legal, security, operational, business, or abuse-prevention reasons. Continued use after changes means you accept the updated terms.
19. Governing Law and Severability
These terms are intended to be enforced to the maximum extent permitted by applicable law. If a provision is found unenforceable, the remaining provisions remain in effect and the unenforceable part will be interpreted as closely as permitted to its original intent.
